By enrolling as a member, accessing, or otherwise using THE SYSTEM, you agree to these terms of service and to the conditions contained in both our Privacy Statement and our Anti-Spam Policy. If you do not agree to these terms, you may not use, operate, or distribute THE system in any way, nor may you participate in any affiliate program or programs WebTrafficVault.com may offer. Since WebTrafficVault.com may find it necessary to update our policies as we grow and expand, we reserve the right, at any time, to modify, alter, or update these Terms of Service without notice and without liability. Your continued participation in the WebTrafficVault.com program or use of THE system or any WebTrafficVault.com services following the posting of changes to these terms (including the Privacy Statement) will mean you accept such modifications.

Termination:

You acknowledge and agree that WebTrafficVault.com reserves the right to remove your account at any time, without notice, for a violation of these guidelines or for any other reason deemed to infringe on the rights of other subscribers, or to protect the integrity of the WebTrafficVault.com program or reputation of the company, at the sole discretion of WebTrafficVault.com. Said removal will result in loss of all traffic without recourse or refunds.

Publishing or making false, erroneous, or misleading statements or negative comments about WebTrafficVault.com will result in termination of your account and loss of traffic purchased.

Passwords:

Certain areas of WebTrafficVault.com are password restricted to authorized users ("Restricted Areas"). If you have registered as an authorized user to gain access to the Restricted Areas, you agree that you are entirely responsible for maintaining the confidentiality of your password, and agree to notify WebTrafficVault.com if the password is lost, stolen, disclosed to an unauthorized third party, or otherwise may have been compromised. You agree that you are entirely responsible for any and all activities which occur under your account, whether or not you are the individual who undertakes such activities. You agree to immediately notify WebTrafficVault.com of any unauthorized use of your account or any other breach of security in relation to your password or WebTrafficVault.com which is known to you.

Traffic Delivery Times

All targeted traffic campaigns are guaranteed within 30 days. Altough WebTrafficVault.com offers faster delivery times, due to situations which may arrise within our system we can only guarantee a 30 days delivery period of traffic purchased. Any traffic campaign which is not completed within the 30 day guaranteed time frame will be given a prorated refund.

Surveyed Leads

By purchasing any product or service offered or sold by WebTrafficVault.com you the "Client" fully agrees to all the following terms and conditions. Please DO NOT place an order with WebTrafficVault.com if you do not agree with ALL our Terms of Service.

1.) WebTrafficVault.com is not liable to replace duplicate records in the client's database. A person may signup for similar offers at different websites and at different times.

2.) A 10% margin of error is within the industry's standard when any data list is used. i.e.: (3% postal error, 3% client opt-in typo error, 4-5% client relocation) WebTrafficVault.com as a courtesy will supply the client with 10% additional leads to help compensate for invalid and/or duplicate leads. Under no circumstances can a client demand any additional compensation or refund for duplicate leads or invalid leads. No overage/extra leads are ever provided on sale or clearance items, discounted orders, special orders or specialty lists. We DO NOT reimburse for any lost postage.

3.) In no event shall either party be liable for special, indirect, incidental, or consequential damages, including, but not limited to, loss of use, or loss of profits.

4.) WebTrafficVault.com sells prospect lists only. All mailing lists are created by actual consumers not us. All information is completely & solely based on the consumer's accuracy and integrity when responding to one of many national advertising campaigns. WebTrafficVault.com has no control over the accuracy of such information and does not guarantee its accurateness or completeness. We DO NOT guarantee sales or conversions. By placing your order you agree that you CAN NOT chargeback citing dissatisfaction with quality or service.

5.) Client agrees not to use the data in violation of any federal, state, or local law, rule or regulation. WebTrafficVault.com agrees to provide all data and information from recognized industry compilers and other sources. WebTrafficVault.com shall not be liable for loss of profits, or for any other claims regardless of the form of action. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTIBILTY OR FITNESS FOR A PARTICULAR PURPOSE.

6.) The relationship between WebTrafficVault.com and the Client will be governed by, and construed in accordance with, the laws of the State of Nevada. Client hereby irrevocably consents to the exclusive jurisdiction of the courts of the State of Nevada and the federal courts situated in the State of Nevada in connection with any action arising between the parties.

7.) If any of the terms are held unenforceable, the reminder of the terms shall remain in effect.

8.) WebTrafficVault.com reserves the right to terminate or edit this agreement anytime, with or without cause. Termination notice may be provided via email or by any other public means and will be effective immediately.

9.) By agreeing to this Agreement, the Client warrants that Client (or Authorized Representative of the Client) is at least 18 years of age, and that there is no legal reason that Client cannot enter into a binding contract.

10.) Your order is generated to your specifications therefore ALL SALES ARE FINAL AND NO REFUNDS CAN OR WILL BE GIVEN.

Changes to these Terms & Conditions

This policy may be amended from time to time, consistent with the requirements of the terms & conditions.

Please DO NOT place an order with WebTrafficVault.com if you do not agree with ALL our Terms of Service.

Advice Received from WebTrafficVault.com

Any advice, formula, instruction, or any suggestion you receive via WebTrafficVault.com is for informational purposes only and you agree that you are entirely responsible for evaluating the usefulness or safety of any such information.

Limitation of Liability:

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL WebTrafficVault.com BE LIABLE FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, COMPENSATORY, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE MATERIALS IN THIS SITE, EVEN IF WebTrafficVault.com OR A WebTrafficVault.com REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL WebTrafficVault.com’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU FOR THE SUBSCRIPTION DURING THE PERIOD IN QUESTION.

Intended Audience

WebTrafficVault.com controls and operates WebTrafficVault.com from its headquarters in the United States of America. If you use WebTrafficVault.com from outside the United States of America, you are entirely responsible for compliance with applicable local laws, including but not limited to the export and import regulations of other countries in relation to the Content.

Third Party Services

Certain services available for your use on WebTrafficVault.com may be provided by third parties. Your use of such services will be subject to the terms and conditions and privacy policies provided by the applicable third party service providers, and WebTrafficVault.com will have no liability with regard to your use of such services.

Liability

We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors.

General

When requested, WebTrafficVault.com will cooperate fully with law enforcement agencies in any investigation of alleged illegal activity on the Internet.

You assume full responsibility for the legal and responsible promotion of the WebTrafficVault.com program and the use of THE system and undertake to indemnify WebTrafficVault.com from any claims that may arise by your use thereof. All traffic services within are not subject to any refunds after order has been processed.

If you violate these Terms, WebTrafficVault.com reserves the right to terminate service to you without notice. WebTrafficVault.com’s preferred course of action is to advise you of your inappropriate behavior and recommend any necessary corrective action. However, flagrant violations of these Terms, as determined by WebTrafficVault.com in its sole discretion, will result in immediate termination of service. In the event that your account is temporarily inactivated as a result of any prohibited activities, the account may be subject to reactivation charges and/or deposit requirements to be determined by WebTrafficVault.com. You understand that WebTrafficVault.com has the right to terminate any account for any reason that WebTrafficVault.com interprets as an abuse of the account.

You agree that WebTrafficVault.com and its licensors may improve, change, and/or discontinue any of its products, services, programs, and prices described in WebTrafficVault.com, if any, at any time without notice and without liability to you of any kind, and further agree that WebTrafficVault.com can revise these Terms at any time without notice by updating this posting. You agree that your continued use of WebTrafficVault.com after such modifications have been made constitutes your acceptance of such revised Terms.

Notices under and appertaining to this agreement from WebTrafficVault.com may be sent by WebTrafficVault.com to the last email address of any intended recipient.

Notices under and appertaining to this agreement from licensees must be sent by registered mail to the offices of WebTrafficVault.com as indicated on the "Contact Us" page of the WebTrafficVault.com web site.

Any action related to these Terms will be governed by Nevada law and controlling U.S. federal law, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree to submit to the jurisdiction of the courts located in Clark County, in the State of Nevada, for the resolution of all disputes arising from or related to these Terms and/or your use of WebTrafficVault.com.

If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of WebTrafficVault.com to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by WebTrafficVault.com in writing. The Terms comprise the entire agreement between you and WebTrafficVault.com and supersede all prior or contemporaneous negotiations, discussions or agreements, if any, between the parties regarding the subject matter contained herein.

All other rights not specifically granted in this agreement and End User License are reserved by WebTrafficVault.com.
